These terms and conditions apply to and form part of any contract for the supply of goods and/or services by Jett Print to any person (Customer). Where a Customer requests Jett Print to provide goods or services, the work required to be done by Jett Print to fulfill the Customer’s instructions is referred to in these terms and conditions as an Order.
(a) Jett Print may if, requested by the Customer, give the Customer a quote specifying the work required to be done in order to fulfill the Customer’s Order and an estimate of Jett Print’s charge for the performance of such work (Quote). The Quote is an estimate only. It is not binding on Jett Print and Jett Print may charge the Customer for the work actually performed in completing the Order, including any rise in its costs of fulfilling the Order.
(b) Where Jett Print has given the Customer a Quote Jett Print need not commence work until the Quote has been accepted by the Customer (which may be made orally or in writing) and acceptance by the Customer of the Quote will constitute acceptance by the Customer of these terms and conditions.
3. Invoicing and charges:
Jett Print do hold accounts for Customers, all Orders are required to be paid in full at the time of Order placement. Orders will not be processed until Payment has been received in full. Payment is accepted via Credit Card or EFT. Qty’s displayed in online shop are for 1 version only, qty’s cannot be split between versions, you must select qty 2 more for multiple kinds.
4. Credits & Refunds:
If Jett Print deem the Customer is due a refund or credit, Jett Print reserve the right to decide how a refund or a credit will be issued. Either as a credit back into the Customers bank account or kept as credit for use in future purchases with Jett Print. If a refund is issued, the goods rejected must be returned to Jett Print in full.
5. Additional Charges:
In addition to the fees for its services, Jett Print may charge to the Customer fees, charges and disbursements, including but not limited to
(i) fees for any preliminary work performed at the Customer’s request, additional work required to be done as a result of the Customer changing the Customer’s instructions, performing work based on a poor copy, additional work required to be done as a result of corrections made by the Customer, including re pagination or reformatting or the Customer altering the style, type or layout used by Jett Print , for work required to be done urgently, including any overtime costs, changing or correcting, in order to ensure that goods are properly produced, any plates, film, bromides, artwork or any document including computer files supplied for the purposes of the Order by the Customer;
(ii) freight costs and charges for the delivery of goods to the Customer; and
(iii) other charges, fees or disbursements referred to in these terms and conditions and not specified in this clause.
6. Under/Over supplies:
The Customer acknowledges that whilst Jett Print will try to ensure they produce the exact number of items in the Order, owing to human and/or machine/computer error the number of items actually produced may be 5% over or under the number specified in the Order. Where such a discrepancy occurs Jett Print may adjust the amount charged to the Customer for the Order by a pro rata amount to reflect the actual number of items produced.
7. Time for payment and interest:
Payment is required before commencement of works. The Customer must pay Jett Print’s invoice in accordance with the payment terms set out in the invoice. The Customer must also pay any costs, expenses and losses incurred by Jett Print as a result of the Customer’s failure to pay to Jett Print all sums owing by the Customer to Jett Print (including, without limitation, any debt collection and legal costs). Jett Print may charge interest on amounts not paid in accordance with the payment terms set out in the invoice. Jett Print reserves the right to charge a 1.5% surcharge on the invoice total for payments made with Credit Card.
8. Proofs and variations in colour & finishings:
The Customer agrees to these Proofing terms when placing an order with Jett Print : It is the Customers responsibility to check proofs for all errors and omissions, particularly spelling, any phone numbers, addresses, emails & layout. Placing an Order with Jett Print confirms acceptance & full responsibility for all errors, omissions, legal & ethical compliance therein the file/s of the Order placed. Jett Print will not accept liability for errors overlooked by The Customer. If changes are made, or the Customer cancels their order, after they confirmed their approval, additional charges may apply. Please also note, colour may vary from what you see on screen (and Customer expectations) and cannot be guaranteed, colours may vary from job to job & sometimes front to back, particularly if jobs are printed on different stocks & have different coatings or finishes. No claims can be made by the customer in regards to colour variance/difference (this includes any colour shift during a print run & previous print runs) & expectations. Jett Print shall have no liability whatsoever (including without limitation to reprint an Order) if there is a variation in the colour of the finished goods prepared by Jett Print in fulfilling an Order. For solid colour coverage with Letterpress, printing may result in motley and inconsistent colour due to the stocks used for letterpress , impression may also vary in depth. No responsibility will be taken for low quality files supplied to Jett Print. If placing multiple orders, orders are dispatched when ready, Customer orders may not be delivered all at the same time, even though they were ordered at the same time. ETA given by Jett Print is an approximate only, Jett Print strive to achieve this, but cannot guarantee. Printing will not proceed until it has been confirmed via email to Jett Print that the Customer has confirmed that they have read & understood these Proofing terms. Products with round corners are not die cut unless specified, they are cut manually using a radius punch, which may result in not perfectly rounded corners. Supplied files are printed at the size that are supplied at, even the customer requests a different size, it is the customers responsibility to ensure the file supplied is the actual they need it printed at. Customers supplying their own artwork (including upload/s direct to site) to Jett Print automatically agree to these conditions.
Stocks used by Jett Print are of Industry Standard. If you require a certain stock for a specific use, it is the customers responsibility to inform Jett Print ie. if the Customer need labels that will be going on something that will be getting hot, it is up to the customer to inform Jett Print that the stock requires needs to heat resistant, if the customer requires labels that will be getting wet, it is up to the Customer to inform Jett Print that the stock required needs to be water resistant. The customer understands when folding certain stocks, cracking may be visible where the fold is, this will be more noticeable if there is full colour coverage (especially dark colours) on the stock, this cannot be avoided. Other circumstances, not mentioned here, will also be covered herein this Term & Conditions of stock. Accepting an order from Jett Print, confirms the Customer has read & understands this. Jett Print will take no responsibility for an unsuitable stock used if Jett Print were not informed by the Customer as to how the stock was to be used. Customers supplying their own artwork (including upload/s direct to site) to Jett Print automatically agree to these Stock conditions.
The Customer may only reject goods if they do not comply with the Customer’s instructions. If the Customer wishes to reject goods, the Customer must notify Jett Print of the rejection:
(a) if Jett Print has delivered goods to the Customer’s premises or to the premises of a third party under the instructions of the Customer within 7 days of delivery;
(b) within 7 days of notification that goods are ready for collection.
Jett Print will normally dispatch the product within 7 business days from the confirmation of your order and receipt of payment. Delivery times/dates are given as an estimate only. All ETA’s given are in Business days (Monday-Friday), job/order processing is to be completed in full (artwork approval & payment cleared) prior to 12pm to include the order day as a business day. Products will be dispatched from Jett Print as per courier schedules to allow for time to delivery to customer locations. Refunds will not be issued if goods aren’t delivered by a certain time as Jett Print cannot take responsibility for late delivery of orders due to courier or production delays, regardless of ETA’s of delivery times/days given by Jett Print to the Customer verbally, in writing or otherwise.
The risk in goods passes to the Customer:
(a) if Jett Print delivers goods to the Customer’s premises or to the premises of a third party under the instructions of the Customer – at the time goods are handed over to the carrier for transportation to those premises for delivery;
(b) otherwise – at the time Jett Print notifies the Customer that goods are ready for collection.
13. Ancillary materials:
Unless Jett Print and Customer agree otherwise, drawings, sketches, paintings, photographs, designs, typesetting, dummies, models, negatives, positives, blocks, engravings, stencils, dies, plates or cylinders, discs, tapes, compact discs, or other media or data and other material produced by Jett Print in the course of or in preparation for performing the Order (whether or not in fact used for the purposes of performing the Order) and all disks, tapes, compact disks or other media (other than media supplied by the Customer) used by Jett Print to store data for the purposes of completing the Order are the property of Jett Print .
14. General lien:
Jett Print shall, in respect of all sums owed by the Customer to Jett Print , have a general lien on all property of the Customer in Jett Print ’s possession and may, after 14 days’ notice to the Customer, sell that property and apply the proceeds (net of any sale costs) in satisfaction of all or any part of the sums owed. If any of the Customer’s property held by Jett Print enjoys copyright protection in favour of the Customer, the Customer hereby grants to Jett Print a license to exercise the rights conferred on Jett Print under this clause.
15. Non-excludable Rights:
Under applicable State and Commonwealth law certain conditions and warranties may be implied in these terms and conditions and there are rights and remedies conferred on the Customer in relation to the provision of goods and/or services which cannot be excluded, restricted or modified by agreement (Non-excludable Rights).
16. No liability:
All conditions, representations and warranties, express or implied, and all rights and remedies conferred on the Customer, by statute, the common law, equity, trade, custom or usage or otherwise in respect of the supply of the goods and/or services by Jett Print to the Customer are excluded other than any Non-excludable Rights. To the extent permitted by law, Jett Print shall have no liability whatsoever in connection with the supply by Jett Print of goods and/or services to the Customer and the liability of Jett Print for a breach of a Non-excludable Right is limited, at Jett Print’s option, to the supply of the goods and/or any services again or payment of the cost of having the goods and/or any services supplied again.
17. Indirect losses:
Despite any other provision of these terms and conditions and to the extent permitted by law, Jett Print shall not (whatever the cause) be liable in contract, tort (including, without limitation, negligence or breach of statutory duty) or otherwise to compensate the Customer for any increased costs or expenses, any loss of profit, revenue, business, contracts or anticipated savings, any loss or expense resulting from a claim by a third party or any special, indirect or consequential loss or damage of any nature whatsoever caused by Jett Print in connection with the supply by Jett Print of the good and/or services to the Customer, including failure to complete or delay in completing the Order and failure to deliver the goods.
18. Intellectual property and Customer indemnity:
Copyright in all artistic and literary works authored by Jett Print shall be the property of Jett Print .The Customer:
(a) warrants that the Customer has copyright in or a licence to authorise Jett Print to reproduce, all artistic and literary works and other intellectual property supplied by the Customer to Jett Print for the purposes of the Order and the Customer hereby expressly authorises Jett Print to reproduce all and any of such works and intellectual property for the purposes of filling the Order; and
(b) indemnifies Jett Print against all claims, demands, liability, losses, costs and expenses (including legal expenses) suffered or incurred by Jett Print in any way directly or indirectly connected with any breach of copyright, any rights in relation to copyright or of any other intellectual property rights in such literary and artistic works or other material supplied to Jett Print by or on behalf of the Customer.
19. Force Majeure:
Jett Print will have no liability to the Customer in relation to any loss, damage or expense caused by Jett Print’s failure to complete the Order or to deliver goods as a result of fire, flood, tempest, earthquake, riot, civil disturbance, theft, crime, strike, lockout, breakdown, war, the inability of Jett Print’s normal suppliers to supply necessary materials or any other matter beyond Jett Print’s control.
20. No Waiver:
A party does not waive a right, power or remedy if it fails to exercise or delays in exercising the right, power or remedy. A single or partial exercise by a party of a right, power or remedy does not prevent another or further exercise of that or another right, power or remedy. A waiver of a right, power or remedy must be in writing and signed by the party giving the waiver.
A term or part of a term of these terms and conditions that is illegal or unenforceable may be severed from these terms and conditions and the remaining terms or part of a term of these terms and conditions continue in force.
22. Governing law and jurisdiction:
These terms and conditions are governed by the law of New South Wales and each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of New South Wales.
23. Goods and Services Tax (GST):
All amounts expressed or described in these terms and conditions (and those expressed on Quotes and/or Invoice supplied to The Customer by Jett Print ) are GST inclusive. This includes all out of pocket expenses. Jett Print will take all available steps to assist with compliance of GST laws.
24. File Storage
Jett Print reserves the right to delete files that have not been accessed for 1 year. This includes supplied files & files created/designed by Jett Print. Due to the high volume of printing we undertake, Jett Print are not able to offer an archival or retrieval service for client’s artwork.
25. Social Media
Jett Print reserves the right to publish images (and details of print specifications, not invoice details) of customers orders on social media platforms. It is the customers responsibility to inform Jett Print at the time of order placement if they do wish Jett Print to use images of the products for this purpose.
